FitGo Terms of Use
Welcome to FitGo. These Terms of Use ("Terms") govern your access to and use of the FitGo mobile application, website, and related services (collectively, the "Service"). By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Acceptance of Terms
By accessing or using FitGo, you confirm that you are at least 18 years old, or that you have the consent of a parent or legal guardian if you are under 18. Your continued use of the Service constitutes acceptance of these Terms and any future updates.
2. Service Description
FitGo provides on-demand home workout programs, personalized fitness plans, exercise video guidance, progress tracking tools, and related fitness content. The Service is intended for informational and educational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment.
3. User Accounts
- You may be required to create an account to access certain features.
- You are responsible for maintaining the confidentiality of your account credentials.
- You agree to provide accurate, current, and complete information during registration.
- You are responsible for all activities conducted under your account.
4. Subscriptions & Payments
4.1 Premium Subscription
FitGo offers auto-renewing subscription plans (monthly or annual) that unlock full access to all workout programs, premium challenges, and advanced features.
4.2 Billing
- Payment will be charged to your iTunes Account at confirmation of purchase.
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period, at the selected plan rate.
- You can manage your subscription and turn off auto-renewal by going to your iTunes Account Settings after purchase.
4.3 Free Trial
Any unused portion of a free trial period will be forfeited when you purchase a subscription. Free trial eligibility is determined at our sole discretion.
4.4 Refunds
Subscription fees are generally non-refundable. Refund requests are handled by the platform provider (Apple App Store) in accordance with their policies. We do not issue partial refunds for unused subscription periods.
5. User Conduct
You agree not to:
- Copy, modify, distribute, or reverse-engineer any part of the Service;
- Use the Service for any unlawful, harmful, or commercial purpose;
- Interfere with or disrupt the security or functionality of the Service;
- Upload or transmit malware, viruses, or harmful code;
- Impersonate any person or entity or misrepresent your affiliation.
6. Intellectual Property
All content within FitGo — including workout videos, text, graphics, logos, trademarks, software, and training plans — is owned by or licensed to FitGo and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without prior written permission.
7. Health & Medical Disclaimer
- Always consult a physician or qualified healthcare provider before starting any new exercise or fitness program, especially if you have pre-existing health conditions, injuries, or are pregnant.
- Exercise involves inherent risks of injury. FitGo is not liable for any injuries, pain, or health issues resulting from your use of the workout content.
- The Service does not provide medical advice, diagnosis, or treatment. Reliance on any information provided is solely at your own risk.
8. Limitation of Liability
To the maximum extent permitted by applicable law, FitGo and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, or profits, arising out of or related to your use of the Service.
9. Modifications to the Service
We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice. We are not liable to you or any third party for any such changes.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.
